01 · <em>Definitions</em>
In these terms, “Nautica Construction” or “we” means Nautica Construction Inc., a California company. “Client” means the person or company requesting our services. “Project” means the work described in a written estimate or contract. “Estimate” means our written price proposal for a Project.
02 · <em>Estimates & quotes</em>
All estimates are free and create no obligation. An estimate is based on the information you provide and may change after a site visit or once final measurements, materials, and finishes are confirmed. A binding quote requires a signed written contract. Written quotes are valid for 30 days from issue.
03 · <em>Scope & changes</em>
Work is performed according to the written scope of work. Any change to the scope, materials, or finishes must be approved in writing before it is performed and may affect the price and timeline. Unauthorized changes made by the client or their representatives are not covered by our warranty.
04 · <em>Permits & inspections</em>
Where required, we obtain building permits and schedule inspections with the local jurisdiction. Permit fees are included in the quote when known in advance. We are not liable for delays caused by municipal permitting or inspection schedules.
05 · <em>Payment</em>
The payment schedule is defined in your written contract and is tied to project milestones. Final payment is due upon completion and client walkthrough. We comply with California law, including the California Mechanics Lien Law: payments we receive are applied to labor and materials provided for your Project.
06 · <em>Warranties & liability</em>
Nautica Construction is licensed, bonded, and insured (CA CSLB #900262). We warrant our workmanship as stated in your contract. Our liability is limited to the coverage of our insurance policies and does not cover damage caused by client-supplied items, pre-existing conditions, or events beyond our reasonable control. This website and its content are provided “as is” without warranties of any kind.
07 · <em>Client responsibilities</em>
- Provide safe access to the property during working hours.
- Make decisions and approvals promptly to keep the Project on schedule.
- Disclose known hazards, including asbestos, lead paint, mold, or unpermitted prior work.
- Secure valuables and personal items during construction.
08 · <em>Photography</em>
We may photograph or film completed work for our portfolio and marketing materials. If you prefer your Project not be published, let us know in writing before work begins.
09 · <em>Governing law</em>
These terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute shall be resolved in the state or federal courts of Santa Clara County, California.
